Amber Eck is an experienced lawyer who has been litigating all aspects of complex individual and class actions for the past 15 years, with an emphasis on securities and derivative litigation, consumer fraud and general business litigation.
Amber Eck is currently serving as class counsel in a nationwide consumer fraud class action against Trump University interim co-lead counsel in a nationwide consumer fraud class action against Sony Electronics, co-counsel in a securities fraud Section 11 class action against CardioNet, interim co-lead counsel in a nationwide consumer fraud class action against Apple regarding its power adapters, interim co-lead counsel in an employment class action against Tommy Bahama regarding California Labor Code violations, counsel in an antitrust action against Apple involving indirect purchasers of iPods, lead counsel in a California employment/wage and hour class action against 3 Weiss Guys, counsel for a nationwide class of consumers against Public Storage, and counsel in a pro bono South Africa Apartheid human rights and trafficking case.
Before joining Zeldes & Haeggquist, LLP, Ms. Eck was a partner at the nation's largest plaintiff's class action firm, Coughlin Stoia Geller Rudman & Robbins, LLP ("Coughlin Stoia," formerly known as Milberg Weiss). Over her 12 years at Coughlin Stoia, Ms. Eck litigated cases alleging improper fees in workers' compensation insurance, improper fees in home mortgage contracts, violations of the ADA and improper searches of the homes of welfare applicants. Ms. Eck was also instrumental in litigating numerous shareholder class actions on behalf of defrauded investors, which resulted in substantial recoveries for the investors, and extensive corporate governance changes, including:
- $80 million settlement against Hanover Corp. (and unprecedented corporate governance reforms)
- $50 million settlement against Sprint (and adoption of 60+ new corporate governance provisions)
- $42.3 million settlement against Fruit of the Loom, Inc.
- $29.5 million settlement against Plains All American Pipeline
In addition, Ms. Eck prosecuted numerous shareholder derivative actions against the executives of companies charged with violating the nation's environmental, labor, health and safety and securities laws, conferring millions of dollars in added shareholder value through tailored corporate governance reforms designed to prevent future harm, including: Merck (securities law violations), Mercury (stock option backdating), Cryolife (violations of health and safety laws); Westland (breach of fiduciary duty and self-dealing), St. Paul (insurance law violations), EDS (securities law violations), and Chiquita (illegal payments to terrorist groups in violations of US law).
Before joining Milberg Weiss, Eck was a defense attorney for 2 years at Chapin Fleming & Winet, specializing in complex civil litigation, and most recently, Ms. Eck served as Law Clerk to the Honorable Jan M. Adler, United States Magistrate Judge for the Southern District of California.
Ms. Eck received the Distinguished Service Award for pro bono service in Sanchez v. County of San Diego (2002), which was the subject of a "Colbert Report" feature and the Wiley W. Manuel Pro Bono Service Award for Badua v. City of San Diego (1999).
Ms. Eck is currently serving as a Barrister in the William B. Enright American Inn of Court, and as a Barrister in the Louis M. Welsh American Inn of Court. She is also a member of the Lawyers Club, San Diego County Bar Assn., Employment Law Section and Business & Corporate Law Section, Association of Business Trial Lawyers, and Federal Bar Association, and formerly served on the Board of Directors for the San Diego Barristers Club. Ms. Eck is admitted to practice in California and Nevada.
